Terms of Service

Who These Terms Apply To

These Terms govern use of yito, the AI creative service operated by the contracting operator identified above (“yito,” “we,” or “us”). If you use yito for an organization, you confirm that you can bind it. You must be at least 18 or the legal age of majority where you live and able to enter a contract.

The Service and Human Review

yito provides tools for generating and editing video, images, avatars, voice, advertising, product content, and other creative assets. Outputs are probabilistic and may be inaccurate, inconsistent, offensive, or similar to material generated for someone else. Review every Output before publishing it, buying media, making a claim, or relying on it.

Model availability, duration, format, controls, and credit price may change. We may pause a model or feature when provider, security, quality, legal, or billing checks fail. A catalog listing is not a guarantee of uninterrupted production availability.

Accounts and Security

You are responsible for your account, authorized organization members, connected commerce accounts, and activity performed through them. Provide accurate information, protect credentials, apply least privilege, and report unauthorized access promptly. You may not sell or share access, or automate it to evade plans, limits, credits, safety controls, or review.

Inputs, Consent, and Instructions

You retain rights you already hold in prompts, files, product data, brands, scripts, recordings, faces, voices, and other material you submit (“Inputs”). You grant yito and the required providers a limited worldwide license to host, copy, transform, transmit, and process Inputs and Outputs only to operate, secure, support, and improve the service as described in the Privacy Policy.

You represent that:

• You own the Inputs or have every permission, license, authorization, and commercial-use right required for the requested use.
• Every identifiable person whose face, body, performance, or voice you submit has given informed and explicit consent for the requested AI use and distribution.
• You will not submit a minor's image or voice for cloning, face swap, avatar, synthetic performance, or sexualized content.
• Product claims, endorsements, prices, disclosures, and regulated statements are accurate and approved by an authorized person.
• You will follow destination-platform rules and disclose synthetic or altered content when required by law, advertising rules, or context.

Sensitive identity workflows require a current consent confirmation in the product. That confirmation records your representation; it does not transfer rights or prove that consent exists. Keep the underlying authorization evidence.

Outputs and Commercial Use

As between you and yito, and to the extent permitted by applicable law, you may use Outputs for personal or commercial purposes subject to these Terms, your plan, and disclosed provider or third-party restrictions.

yito does not transfer rights it does not own and does not guarantee that an Output is copyrightable, unique, non-infringing, trademark-safe, factually accurate, or cleared for publicity, music, voice, model, or other third-party rights. You are responsible for clearance and final use. The yito software, interface, documentation, branding, and original platform content remain owned by yito or its licensors.

Prohibited AI and Content Uses

You may not use yito to create, upload, distribute, or facilitate:

• Non-consensual intimate imagery, sexual deepfakes, sexual content involving minors, grooming, or exploitation.
• Impersonation, fraud, phishing, identity theft, forged evidence, deceptive endorsements, or misleading political or election content.
• Face, voice, or avatar cloning without documented consent, including deceptive use of a public or private person.
• Harassment, doxxing, credible threats, hateful abuse, or content that facilitates violence or self-harm.
• Illegal goods or services, malware, credential theft, safety-control evasion, or instructions intended to cause material harm.
• Infringing content, counterfeit listings, unauthorized logos or characters, or removal of rights-management or provenance information.
• Automated decisions in employment, credit, housing, insurance, healthcare, legal services, or another high-impact area without lawful authority and meaningful human review.
• Explicit adult content or content prohibited by an applicable model provider or distribution platform.

Do not remove or alter AI labels, provenance metadata, content credentials, or disclosures to mislead. yito currently provides a response label and permission-matched machine-readable sidecar for generated media, but it does not embed or cryptographically sign a content credential. You remain responsible for any visible disclosure the context requires.

Visibility and Shared Links

New signed-in generations are private by default. If you deliberately make a creation public or share a public link, anyone with access may view or redistribute it. Verify visibility and remove confidential, personal, or licensed-only material before sharing.

Moderation, Takedowns, and Appeals

We may use automated and human review to reject, restrict, preserve, or remove content and accounts that may violate these Terms, provider rules, or law. Send urgent safety concerns and notices of infringement, impersonation, non-consensual imagery, or privacy violations to contact@yito.ai.

A notice should include contact details, the exact yito URL or task/artifact identifier, the right or policy involved, why the use is unauthorized, a good-faith and accuracy statement, and a physical or electronic signature. We may ask for evidence, notify the affected user where lawful, preserve records, restrict access during review, and terminate repeat infringers. To appeal, provide the decision reference, authorization evidence, and why the decision was incorrect. False or abusive notices are prohibited.

Payments, Credits, and Refunds

Paid features are billed in advance at the amount and currency shown at checkout. Subscriptions renew at the disclosed interval until canceled. Cancel future renewal in Settings → Billing before the next charge; cancellation does not automatically refund the current paid period.

Credits expire as displayed in Billing or at purchase, have no cash value, and cannot be transferred outside yito. Hosted payment providers process full payment details; yito does not store full card numbers. Taxes, currency conversion, and issuer fees may vary.

Refunds are reviewed under the Refund Policy. Releasing or returning credits after a failed generation is a balance correction, not a cash refund.

Suspension, Closure, and Retained Records

You may close an eligible account in Settings after resolving active subscriptions, pending payments, organization ownership, active generations, and reserved credits. We may suspend or terminate access for violations, security risk, fraud, legal demands, or material harm.

Account closure revokes access and redacts or anonymizes eligible active account and generation data as described in the Privacy Policy. Necessary billing, audit, fraud-prevention, backup, dispute, and legal records may be retained.

Disclaimers and Liability

The service and Outputs are provided “as is” and “as available” to the extent permitted by law. We disclaim implied warranties of merchantability, fitness, non-infringement, and uninterrupted or error-free operation.

To the maximum extent permitted by law, yito is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profit, data, goodwill, or business opportunity. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.

Changes and Contact

We may update these Terms when the service, law, or providers change. Material changes will be identified by the updated date and, where appropriate, an in-product or email notice. Continued use after the effective date means you accept the revised Terms.
